US Magnitsky Law draws Kremlin ire ? but many Russians support it

Russia's State Duma will take up a stern new bill Tuesday, the Dima Yakovlev List, aimed at punishing US officials who are implicated in human rights violations against Russians, including adoptive children who die at the hands of American parents and others allegedly abused by the US justice system.

The Duma bill appears to be pure retaliation for the Magnitsky List, targeted against Russian officials involved in the 2009 prison death of Russian anti-corruption whistleblower Sergei Magnitsky, which was signed into law by President Obama on Friday.

The Yakovlev List, named after one of about 15 Russian children to die at the hands of their adoptive US parents in the past two decades, will levy tough economic and visa sanctions against American officials perceived to be involved in mistreatment of Russians.

While most Americans seem likely to ignore the Yakovlev List, a recent poll suggests that a plurality of Russians may be delighted to see their own officials squirm under the pressure of the Magnitsky Act. A late November survey by the independent Levada Center in Moscow found that 39 percent of Russians fully or mostly agree with the import of the US law, while just 14 percent reacted negatively toward it. Another 48 percent of Russians said they were undecided.

"This suggests that as much as people may dislike the idea of the US interfering in our internal affairs, they hate their own officials more," says Masha Lipman, editor of the Moscow Carnegie Center's Pro et Contra journal.

"Apparently much of the public would be happy to see corrupt Russian officials punished, however and by whomever.... What we see at work here is growing public anger against [the bureaucracy]. It may not show up as street protests, but it's a very real factor," she adds.

This cold war-style legislative tit-for-tat is erupting at what might have been a positive moment in US-Russia relations. After nearly four decades of hexing ties between Moscow and Washington, the much-resented Jackson-Vanik amendment was abolished by the US Senate in early December, and along with it the humiliating requirement that Russia obtain annual certification of its human rights record in order to enjoy normal trade relations with the US.

But senators replaced Jackson-Vanik with the Magnitsky List, which more narrowly targets Russian officials implicated in Mr. Magnitsky's case and other alleged human rights violators. The reaction of official Russia last week was white hot. Russia's Foreign Ministry said in a statement Friday that the Magnitsky List amounts to "open meddling in our internal affairs and is a blind and dangerous position." President Vladimir Putin told Russian TV viewers last week that the US law was a "purely political, unfriendly act."

"The [Magnitsky List] is a crazy precedent, because a legislative body has taken over the functions of a court," says Andrei Klimov, deputy chair of the Duma's international affairs commission, which was responsible for drafting the retaliatory Yakovlev List.

"For the first time in human history they presume to nominate the 'guilty' and then keep the list secret.... This is already influencing our relationship [with the US], all this past year while it was being discussed," he adds.

WHO WAS MAGNITSKY?

Magnitsky was a lawyer working for the London-based Hermitage Capital ? once the largest foreign investor in Russia ? when he uncovered what he alleged was a vast scam by top Russian police and tax officials to embezzle $230 million in taxes paid by Hermitage firms in 2006.

He went to the State Investigative Committee, Russia's top investigative body, and testified that officials had falsely re-registered Hermitage companies under other names, using company seals and charters seized in an earlier police raid, and subsequently received a full tax rebate with the help of highly-placed accomplices in the tax department.

The Investigative Committee has apparently never looked into Magnitsky's evidence. Instead, Magnitsky was soon arrested by the very same police officers who had conducted the earlier raid on Hermitage's Moscow office and charged, ironically, with tax evasion. Within a year, Magnitsky was dead. A report by the Kremlin's own human rights commission concluded in 2011 that Magnitsky had been systematically denied medical attention, was illegally prosecuted by the same officials he had implicated, was almost certainly beaten to death, and the whole affair was subsequently covered up.

Russia's top prosecutor has announced that the deceased Magnitsky will be put back on trial in January, with his mother standing in for him, even though such a posthumous trial is of dubious legality and has no precedents in Russian law.

"Official behavior in the Magnitsky case is bizarre. They seem convinced that it's all a humiliation of Russia, though there is serious evidence that has been gathered by foreigners about the case, who were basically doing the work that our investigators should have done," says Viktor Kremeniuk, deputy director of the official Institute of USA-Canada Studies in Moscow.

Magnitsky's former boss and head of Hermitage Capital, Bill Browder, has spent the past three years bankrolling private investigators and lobbying foreign governments to enact legislation like the Magnitsky List. He has compiled a 75-page report which summarizes what looks like a devastating case against an alleged crime organization inside Russia's government and the systematic efforts of the Kremlin to protect it.

'A POSITIVE STEP'

"The Magnitsky Act is a positive step; for the first time international legal sanctions are targeting Russian human rights violators," says Yevgeny Ikhlov, an expert with For Human Rights, a grassroots Moscow-based coalition.

"It means that the international community is starting to recognize that the routine conspiracies against justice practiced by Russian officials represent a threat beyond the borders of Russia," he adds.

But Sergei Markov, vice rector of the Plekhanov Economic University in Moscow and a frequent adviser to President Putin, argues that the US has started a diplomatic fight with the Magnitsky Act that can only befoul the relationship and block any productive outcomes in the Magnitsky case.

"An insult has to be answered," he says. "The US law violates the presumption of innocence concerning a number of Russian state officials, it expresses a lack of trust toward the Russian legal system, and there is considerable fear that the number of people added to the list will keep growing.... What worries me most is that this the Magnitsky Act might start a chain of negative reactions."

Medical examiner: all Sandy Hook victims died of multiple gunshot wounds

NEWTOWN, Conn.-- Dr. H. Wayne Carver, the medical examiner investigating Friday's massacre at Sandy Hook Elementary School, said autopsies completed on the 20 children and six adults on Saturday showed they were killed with multiple bullets fired by rifle at close range.

"This is the worst I've seen," Palmer told reporters gathered at Treadwell Park, less than a mile from the school where the shooting occurred.

Lt. Vance distributed a photocopied list with the names and dates of birth of the victims, including 12 girls and 8 boys, most of them born in 2006.

The youngest was Noah Pozner, who celebrated his 6th birthday in November. Josephine Gay, another victim, turned 7 on Dec. 11, three days before the massacre. The oldest victim identified Saturday was Mary Sherlach, age 56.

All of the adult victims were women, aged 27 to 56.

Autopsies on the suspected shooter, who police say shot himself, and his mother--who was found dead in their Newtown home--would be conducted Sunday, Palmer said.

Police have still not released his name. "You have to understand this is an ongoing investigation, with an active crime scene," Carver said.

Carver told reporters that the victims had all been identified and their bodies released. In what appeared to be an uncomfortable moment for Carver, he said all of the victims he had examined so far had all been shot by a Bushmaster .223 caliber assault rifle, one of at least two weapons 20-year old Adam Lanza used to commit one of the deadliest mass shootings in U.S. history.

"This is only the second press conference I have ever done," in more than 30 years, Carver noted dryly.

Lanza allegedly gunned down his mother, Nancy Lanza, at their home Friday before driving to Sandy Hook and forcing his way inside to commence the deadly shooting spree. Autopsies on the bodies of the gunman and his mother are still pending, Carver said.

Before the names of the victims were released, First Selectman Patricia Llodra urged the crush of media assembled at the park to respect their families.

"Please treat out community with kindness," Llodra said. "We need your help on this healing journey."

Earlier, Sen. Richard Blumenthal met with local officials and families in Newtown, but refused to engage in the debate over gun control in the wake of the shooting.

"We're going to have that conversation at another time," Blumenthal told Yahoo! News. "Right now my focus is on the this community, and the families and the continuing shock and grief they are experiencing."

He added: "I can't imagine any job tougher than to tell parents their 7-year-old is gone. It's the worst nightmare for any parent."

The Connecticut State Police released the names of the 26 victims at the news conference. The full list is included below:

Marrakech '12: Zhang Yimou Talks Working With Christian Bale, The Growing Chinese Box Office & More

Zhang Yimou ("Raise the Red Lantern," "Ju Dou," "Hero," "House of the Flying Daggers") has been making movies in his homeland of China, from within the system, for the past two and a half decades. During this time, he has witnessed, and participated in, the gradual, incremental thawing of Chinese relations with the West, and the partial loosening of the viselike grip of governmental control over film production. Honored with a tribute at the Marrakech International Film Festival, and presenting his newest film "The Flowers of War", Zhang spoke, through two translators (Mandarin-French, French-English) to a small group of journalists about his filmmaking life under a notoriously repressive regime, the themes he revisits, and working with Christian Bale. Here are five highlights from that conversation.

1. Yimou's characteristic focus on female protagonists is his way of paying tribute to his mother.
"I respect women a lot probably because of the role my own mother had in my life. At the time I was born, because of the political situation, I was considered born 'under a bad sign' but my mother had the courage to fight that and to make my life easier and even to bring joy into our family which wasn?t easy at that time," he explained. "So I think I had a tribute to pay to the difficulties she had to undergo. And in general in Chinese society women are under pressure more than men, and if you look at my work I tried to deal with this pressure that people have to cope with and women were a good angle to do that from."

2. In China, the political situation has eased internally for filmmakers??
"[For many years] censorship was very strict at every stage of filmmaking?but nowadays these things have changed. There are some subjects which are still taboo, and we wish for more freedom as film directors, but as any Chinese film director can tell you, now we can mostly make the films we want to make?," he said. "Maybe I can give you one clue about the evolution of China: we?re here now sitting and talking? [which would not have been allowed previously]."

3. ?but this relative openness is presenting its own challenges.
"Every day now there are 5 new screens in China. Nowadays China has become the second biggest market in the world, in terms of box office So as filmmakers we have to adapt to this evolution and to the requests of the market and so use ingredients in our films that are likely to attract more viewers...Now we feel the pressures of commercial filmmaking under the influence of Hollywood."

4. And so casting Christian Bale in "Flowers of War" was both appropriate and useful
"What matters most for me is the loyalty to the original story and here because of this period of time, during this massacre, there were foreigners in China, so it made sense to cast a foreigner. That?s why we chose Christian Bale," Yimou shared.?

"But of course there are investors who want to see who you?re working with and who the cast is and of course the mention of Christian Bale?s name was helpful in getting them to invest more in the film," he continued. "And then Bale was kind enough to give us a discount on his normal salary, so he wasn't too expensive for us. And the collaboration then was very smooth and nice because he is a great professional and also a very kind man, very caring with the children in the cast. Working with him was nothing but pleasure."

5.Though his films range from small studies to sweeping epics, Zhang feels his focus has remained the same
"I haven?t changed much. The inspiration that I get is from human beings, and I?m interested in the stories of the individual. History changes and Chinese society has evolved but as I?m interested in individual destinies I still have the same relationship with them," he reflected.

"Retrospectively I realise my work has allowed me to deal with different aspects of human life and also to have a bridge with other people, to have connections with people all over the world. That is what I feel it has brought me -- being able to relate to people all over the workd from all different cultures. And so now retrospectively I feel grateful for having become a director," he added. "But I?m still interested in the same aspects of human life and in fact the next film that I?m going to shoot is the kind of film you might refer to as my early films - a smaller budget, a more intimate approach."

"We tried to change it to any time in the game because last year I guess it was everyone was fouling Tiago Splitter early on and the [rules] committee didn't want to do it. And so that's just the way it is. Because the reality is that there are a lot of basketball purists ? and I understand that point of view ? who say, 'Hey, why don't you learn to shoot foul shots? You're supposed to be a pro.'"

Howard looked amateurish at the free-throw line for most of this week when teams intentionally fouled him. He made seven of 14 free throws in the fourth quarter against Orlando and five of 10 late in the game against Houston before making both of his attempts when New Orleans tried the ploy.

The Lakers managed to avoid a hack-a-Howard scenario against Oklahoma City. Trailing by double digits for most of the second half might have had something to do with it.

Fossilized hopes

Last season's 23-43 record might qualify as heady times in Toronto, where the Raptors are a bigger flop than the fictionalized theme park Jurassic Park.

A quarter of the way through the season, the four-win team doesn't even have one victory for each of its middling starters. Trade rumors are rampant and frustration hasn't just boiled over but evaporated everything in the pot.

"I can't put into words how frustrating this is. It just sucks," guard DeMar DeRozan told reporters Wednesday night after receiving a technical foul during a loss to Sacramento, the Raptors' ninth defeat in their last 10 games. "We try to work as hard as we can, but the ball don't bounce our way, it don't go in when we need it to go in, everything you can think of goes against us."

Getting babied

The entourages of Dion Waiters, Tyler Zeller and Kevin Jones grew unexpectedly this week.

Bad Santa fired from mall gig after parents complain on Facebook

That?s what happened at the Maine Mall in Portland. On Monday, Mother Jess Mailhiot wrote on the mall?s Facebook page that the mall?s Santa refused to let her young daughter sit on his lap because she didn?t purchase pictures:

Because we did not purchase any photo packages the gentleman mumble something to Santa and when my daughter who is six was going to sit on his lap Santa put his hands together and placed them on his legs so she couldn't sit on him. Santa was not attentive and brushed her off all because we did not purchase pictures. Why don't you just put up a sign saying NO PICTURES NO SANTA. My daughter was hurt and I so disappointed. Shame on you!

Maine Mall?s policy, it stressed on Facebook, is that purchasing pictures is completely optional, and admitted that the Claus Mailhiot met was ?very grumpy.? But that wasn?t his only alleged offense.

Speaking to local news reporters, Mailhiot?s daughter went further, saying that she asked for an American Girl doll, but that the Santa replied she?d receive an ?American football? instead.

Other parents chimed in on the same Facebook page.

?we did purchase a package, he broke all 3 of my girls hearts by brushing them off and not even responding to them when they talked to him! extremely disappointed and bummed,? wrote Kari Henderson.

?I took Bella and her friend,? wrote Trish Moulton. ?Santa told her friend she didn't really want what she asked for. The girls are 8 and said Santa was being weird.?

?Very disappointed in Santa this year,? wrote Ka Judice. ?He made my 11 year old son cry - basically told him he was being greedy.?

That was enough for the Maine Mall to fire that Santa, it posted to Facebook

Though that placated some users, a few weren?t satisfied. Ken Moore for instance, demanded the mall think of the children:

Indiana Jones (Harrison Ford) is no ordinary archeologist. When we first see him, he is somewhere in the Peruvian jungle in 1936, running a booby-trapped gauntlet (complete with an over-sized rolling boulder) to fetch a solid-gold idol. He loses this artifact to his chief rival, a French archeologist named Belloq (Paul Freeman), who then prepares to kill our hero. In the first of many serial-like escapes, Indy eludes Belloq by hopping into a convenient plane. So, then: is Indiana Jones afraid of anything? Yes, snakes. The next time we see Jones, he's a soft-spoken, bespectacled professor. He is then summoned from his ivy-covered environs by Marcus Brody (Denholm Elliott) to find the long-lost Ark of the Covenant. The Nazis, it seems, are already searching for the Ark, which the mystical-minded Hitler hopes to use to make his stormtroopers invincible. But to find the Ark, Indy must first secure a medallion kept under the protection of Indy's old friend Abner Ravenwood, whose daughter, Marion (Karen Allen), evidently has a "history" with Jones. Whatever their personal differences, Indy and Marion become partners in one action-packed adventure after another, ranging from wandering the snake pits of the Well of Souls to surviving the pyrotechnic unearthing of the sacred Ark. Conservative Senator DeMint to resign amid "fiscal cliff"

WASHINGTON (Reuters) - Senator Jim DeMint, a South Carolina conservative and favorite of the Tea Party wing of the party, will resign from the Senate, his office said on Thursday.

DeMint, 61, made waves this week by condemning the offer of House of Representatives Speaker John Boehner, a fellow Republican, to resolve the "fiscal cliff" stand-off.

DeMint will leave the Senate, which Democrats control, in January to run the Heritage Foundation, a conservative think tank in Washington.

This week DeMint said Boehner's offer for $800 billion of increased tax revenues would "destroy jobs and allow Washington politicians" to swell, not reduce, federal deficits.

Boehner made the bid in negotiations with Democratic President Barack Obama to avert the $600 billion in taxes and spending cuts that will start to take effect in January if no deal is reached.

DeMint said he believes the Heritage Foundation will allow him to more broadly popularize conservative views.

"This is an urgent time," DeMint told the Wall Street Journal in an interview before the resignation announcement, "because we saw in the last election we were not able to communicate conservative ideas that win elections."

DeMint was elected in 1998 to the U.S. House, after vowing to serve only three terms. He won election to the Senate in 2004, and was re-elected in 2010.

South Carolina is a solid Republican state and so the retirement is not likely to significantly alter the balance of power in the Senate, where Democrats will control 55 of the 100 seats in January.

South Carolina's Republican governor Nikki Haley will appoint a replacement through 2014, after which there will be a special election.

Notice all the little trophies on the lower shelves, compared to the big ones on top. Accomplishment takes some time and effort, but you earn esteem and confidence.

What does that mean?
This quote explains my dislike of the ?everyone?s a winner? mentality in a nutshell. Yes, it has it?s place for the kinder-gardeners, but at some point, kids have to realize that in life, sometimes things just don?t go their way.

This quote explains the true sources of self-esteem and self-confidence: doing and achieving. If you never have built a pinewood derby car before, expecting to win the first time out is going to result in disappointment.

Trying to accomplish something and failing will help you understand your character, and allow you to build on your failures (both personally and in your project). As both your character and your project improve, your self-esteem and your self-confidence will both improve dramatically.

To me, that is the heart of this quote. Actual accomplishments will tell you what you can do, and build your confidence. Your esteem will climb with your understanding of your ability and capability, as well as your character.

Why is actually accomplishing things important???
Because that?s the way it works in the real world. Those who live in the ?everyone?s a winner? world will eventually find out that it?s not the same in the real world. As much as we might want it to be, it just flat out isn?t that way. If you want something, you have to earn it.

If you want to be the best at something, you?ve got to put in the effort and actually become accomplished in that field. Even if you fall short of being the best, often just the honest effort builds confidence as you learn what you can do, and as it comes more easily with practice. Esteem comes when you are recognized by others for the skill and effort you have shown in your pursuit of your goal.

If you aren?t actually doing anything, any self-esteem and self-confidence you may have is suspect at best. Such compliments as come easily, but dissolve just as quickly when hit with the cold, hard reality. Platitudes and hollow compliments build esteem and confidence without any foundation, and are easily washed away. Then what?

Where can I apply this in my life?
When my son was quite a bit younger, he started bowling with his school. His first year was good, for such a young kid, but he still didn?t earn a top trophy. He got a little ?participant? trophy. He threw a fit and smashed it up pretty bad, destroying the base.

After a very long talk, he started to understand what it meant to earn the trophy. The next semester, he took third, and the next year, he took first both semesters. The trophies meant something, because he earned them. The confidence came from knowing he was good enough to be the big fish, even if it was in a small pond.

As an adult, when someone else tells you that you are doing a great job when you are not, they are usually called a flatterer, and their speech, flattery. Hopefully, you do not do this to others, nor do you allow them to do so to you either. I have a pair of posts (here and here) on the perils of flattery.

While the person saying these things has their own reasons for saying them, the listener has other reasons for listening to their flattery. It generally revolves around issues of confidence and esteem, the very points of the quote.

If you get your value, your confidence and esteem from flattery, it has no substance, and will fall away at the slightest prodding. Then what? Instead, I would stay away from those who would flatter you, and earn your esteem and confidence the hard way, one accomplishment at a time.

The years may tire you, and your position may no longer attract flatterers, but if you have earned your self-esteem and self-confidence the hard way, by accomplishing things, then no one can take that away from you. It will always be something you can look at and say, ?Yes, I built that!?

Take a moment and consider all the things in your life you have accomplished, and all the things you have yet to accomplish. Pick one from the latter list and get busy! Accomplishments take a little planning and a lot of effort, so get busy!

(AP) ? Led by Republican opposition, the Senate on Tuesday rejected a United Nations treaty on the rights of the disabled that is modeled after the landmark Americans with Disabilities Act.

With 38 Republicans casting "no" votes, the 61-38 vote fell five short of the two-thirds majority needed to ratify a treaty. The vote took place in an unusually solemn atmosphere, with senators sitting at their desks rather than milling around the podium. Former Senate Majority Leader Bob Dole, looking frail and in a wheelchair, was in the chamber to support the treaty.

The treaty, already signed by 155 nations and ratified by 126 countries, including Britain, France, Germany, China and Russia, states that nations should strive to assure that the disabled enjoy the same rights and fundamental freedoms as their fellow citizens. Republicans objected to taking up a treaty during the lame-duck session of the Congress and warned that the treaty could pose a threat to U.S. national sovereignty.

"I do not support the cumbersome regulations and potentially overzealous international organizations with anti-American biases that infringe upon American society," said Sen. Jim Inhofe, R-Okla.

He and other opponents were not swayed by support for the treaty from some of the GOP's prominent veterans, including the 89-year-old Dole, who was disabled during World War II; Sen. John McCain, who also suffered disabling injuries in Vietnam; Sen. Dick Lugar, the top Republican on the Foreign Relations Committee; and former Attorney General Dick Thornburgh. Eight Republicans voted to approve the treaty.

The treaty also was widely backed by the disabilities community and veterans groups.

White House press secretary Jay Carney called the vote disappointing and noted that President Barack Obama had declared, in a written statement read in tribute to Dole just before the vote, that "disability rights should not stop at our nation's shores."

Carney said the White House hopes the treaty can be reconsidered in the next Congress.

Democratic support for the convention was led by Foreign Relations Committee Chairman Sen. John Kerry, Senate Democratic Whip Dick Durbin, D-Ill., and Sen. Tom Harkin, D-Iowa, one of the key players in writing the 1990 Americans with Disabilities Act.

"It really isn't controversial," Kerry, D-Mass., said. "What this treaty says is very simple. It just says that you can't discriminate against the disabled. It says that other countries have to do what we did 22 years ago when we set the example for the world and passed the Americans with Disabilities Act."

In a statement after the vote, Kerry said it was "one of the saddest days I've seen in almost 28 years in the Senate and it needs to be a wake-up call about a broken institution that's letting down the American people."

The ADA put the United States in the forefront of efforts to secure equal rights for the disabled, and it became the blueprint for the U.N. treaty, formally the Convention on the Rights of Persons with Disabilities. The treaty was negotiated by the George W. Bush administration. It was completed in 2006 and Obama signed it in 2009.

The United Nations estimates that 650 million people around the world are disabled, about 10 percent of the world's population.

Kerry and other backers stressed that the treaty requires no changes in U.S. law, that a committee created by the treaty to make recommendations has no power to change laws and that the treaty cannot serve as a basis for a lawsuit in U.S. courts.

They said the treaty, by encouraging other countries to emulate the rights and facilities for the disabled already existing in the United States, would be of benefit for disabled Americans, particularly veterans, who want to work, travel or study abroad.

Supporters also rejected the argument that it was inappropriate to consider an international treaty in a post-election lame-duck session. They said that since the 1970s the Senate had voted to approve treaties 19 times during lame-duck sessions.

But in September, 36 Republican senators signed a letter saying they would not vote for any treaty during the lame duck,

The opposition was led by tea party favorite Sen. Mike Lee, R-Utah, who argued that the treaty by its very nature threatened U.S. sovereignty. Specifically he expressed concerns that the treaty could lead to the state, rather than parents, determining what was in the best interest of disabled children in such areas as home schooling, and that language in the treaty guaranteeing the disabled equal rights to reproductive health care could lead to abortions. Parents, Lee said, will "raise their children with the constant looming threat of state interference."

Supporters said such concerns were unfounded.

"I am frankly upset," said Sen. Chris Coons, D-Del., "that they have succeeded in scaring the parents who home-school their children all over this country." He said he said his office had received dozens of calls from home-schooling parents urging him to vote against the convention.

The conservative Heritage Action for America urged senators to vote no against the treaty, saying it would be recorded as a key vote on their scorecard. It repeated the argument that the treaty "would erode the principles of American sovereignty and federalism."

Families grieve in wake of Belcher murder-suicide

KANSAS CITY, Mo. (AP) ? Breaking their silence for the first time, the family of the woman shot and killed by Kansas City Chiefs linebacker Jovan Belcher said Monday their "hearts are truly broken" and asked for privacy while they grieve the loss of two loved ones.

Belcher shot and killed his 22-year-old girlfriend, Kasandra Perkins, at their Kansas City home Saturday before driving to Arrowhead Stadium, where Belcher committed suicide in the practice facility's parking lot, police said. The couple had a 3-month-old daughter, Zoey.

"Our hearts are truly broken for Kasi was a beloved daughter, granddaughter, sister, mother, cousin and friend," the family said in an emailed statement. The family also asked that the media "respect our privacy during this difficult time."

"Please keep us in your hearts and prayers as well as the Belcher family," the statement said.

Kansas City police Sgt. Marisa Barnes said Monday that authorities hope to deliver an investigative report to prosecutors on Tuesday.

"They're moving it along just like any other case. There's a formal process it has to go through," she said.

Dan Ferguson, a spokesman for Jackson County, said the medical examiner's office has completed examinations on the bodies of both Belcher and Perkins. A full autopsy report would not be available for six to eight weeks, he said.

In an incident report released Monday, police said officers were called to the Kansas City home of Belcher, 25, and Perkins about 7:50 a.m. Saturday. Police found Perkins on the floor of the master bathroom. The report said she died from apparent gunshot wounds, but did not say how many times she had been shot.

Belcher then drove about five miles to Arrowhead Stadium. There, he was met by general manager Scott Pioli and coach Romeo Crennel, and Belcher thanked them for all they'd done for him.

The police report said that when officers arrived at Arrowhead about 8 a.m., they saw several people in the practice facility parking lot.

"As they approached, a subject later identified as Jovan Belcher, observed their presence and moved to an area behind a vehicle," the report said. "From that position Belcher shot himself one time in the head." Belcher was taken to a hospital, where he died, the report said.

Barnes said Monday that firearms found at the couple's home were legally registered to Belcher. It is unknown how many guns were found.

"The majority of people own them, you know, especially in the places that they're legal," Chiefs linebacker Brandon Siler said. "People don't go out and shoot other people. Most of the time they're for self-defense or sport. Yeah, people own guns, but did you ever hear him say anything about harming someone with a gun? No."

Chiefs defensive tackle Shaun Smith bristled when asked about a "gun culture" in professional sports, and said players that carry them usually do so for protection.

"Just because we're in the NFL, that doesn't make us no different," he said. "You never know when someone would try to rob you or whatever. ... I've worked hard to get where I am. I'll be damned if I'd let someone just take it away from me, period."

Police spokesman Darin Snapp said Monday that Belcher's mother, who had been staying with the couple, was given temporary custody of the couple's daughter. But, he said, it was unclear Monday if the grandmother and baby were still in the Kansas City area or if they had returned to Belcher's home in West Babylon, N.Y. Perkins was from the Austin, Texas, area.

Chiefs running back Jamaal Charles and his wife, Whitney, also released a statement Monday asking for privacy. In it, the Charles' confirmed that Perkins and Whitney Charles were cousins, and that Perkins was a "not only family, but a friend and a loving mother."

"As my actual family and my Kansas City Chiefs family have been altered forever, we ask that you keep us and most importantly their child in prayer," the Charles' statement said.

Brianne York, 21, a friend of Perkins, said Sunday that Perkins met Belcher through Whitney Charles.

Belcher's relatives also provided statements Monday, as several relatives gathered outside of Belcher's boyhood home, looking somber and sad. Yamiesse Lawrence, a cousin of Belcher's, said the weekend's events were an "inconceivable tragedy."

"As a family, no words can express the sorrow we feel over the loss of Jovan and Kasandra," Lawrence read aloud.

She said the family is "overwhelmed with both sadness and confusion," and extends thoughts and prayers to the Perkins family.

Belcher's niece, Quaresha Boston, said the football player "embraced life and excelled at all he put his energy behind" and that God alone could "mend our hearts."

"We loved Jovan. His kindness, humility, respect and gratitude for family and friends were steadfast," she said. "... He was happy to be a new father and both he and Kasandra loved Zoey greatly."

Students take Facebook to court over privacy policy

VIENNA (Reuters) - An Austrian student group plans to go to court in a bid to make Facebook Inc, the world's biggest social network, do more to protect the privacy of its hundreds of millions of members.

Campaign group europe-v-facebook, which has been lobbying for better data protection by Facebook for over a year, said on Tuesday it planned to go to court to appeal against decisions by the data protection regulator in Ireland, where Facebook has its international headquarters.

The move is one of a number of campaigns against the giants of the Internet, which are under pressure from investors to generate more revenue from their huge user bases but which also face criticism for storing and sharing personal information.

Internet search engine Google, for example, has been told by the European Union to make changes to its new privacy policy, which pools data collected on individual users across its services including YouTube, gmail and social network Google+, and from which users cannot opt out.

Europe-v-facebook has won some concessions from Facebook, notably pushing it to switch off its facial recognition feature in Europe.

But the group said on Tuesday the changes did not go far enough and it was disappointed with the response of the Irish Data Protection Commissioner (DPC), which had carried out an audit after the campaign group filed numerous complaints.

Facebook, due to hold a conference call later on Tuesday to answer customer concerns about its privacy policy, said its data protection policies exceeded European requirements.

"The latest Data Protection report demonstrates not only how Facebook adheres to European data protection law but also how we go beyond it, in achieving best practice," a Facebook spokesman said in an emailed comment.

"Nonetheless we have some vocal critics who will never be happy whatever we do and whatever the DPC concludes."

Losing patience
Europe-v-facebook founder Max Schrems, who has filed 22 complaints with the Irish regulator, said more than 40,000 Facebook users who had requested a copy of the data Facebook was holding on them had not received anything several months after making a request.

"The Irish obviously have no great political interest in going up against these companies because they're so dependent on the jobs they create," Schrems told Reuters.

Gary Davies, Ireland's deputy data protection commissioner, denied Facebook's investment in Ireland had influenced regulation of the company.

"We have handled this in a highly professional and focused way and we have brought about huge changes in the way Facebook handles personal data," he told Reuters.

Schrems also questioned why Facebook had only switched off facial recognition for users in the European Union, even though Ireland is the headquarters for all of Facebook's users outside the United States and Canada.

Facebook is under pressure to reverse a trend of slowing revenue growth by selling more valuable advertising, which requires better profiling of its users.

Investors are losing patience with the social network, whose shares have dropped 40 percent in value since the company's record-breaking $104 billion initial public offering in May.

Last month, Facebook proposed to combine its user data with that of its recently acquired photo-sharing service Instagram, loosen restrictions on emails between its members and share data with other businesses and affiliates that it owns.

Facebook is also facing a class-action lawsuit in the United States, where it is charged with violating privacy rights by publicizing users' "likes" without giving them a way to opt out.

A U.S. judge late on Monday gave his preliminary approval to a second attempt to settle the case by paying users up to $10 each out of a settlement fund of $20 million.

Europe-v-facebook said it believed its Irish battle had the potential to become a test case for data protection law and had a good chance of landing up in the European Court of Justice.

Schrems said the case could cost the group around 100,000 euros ($130,000), which it hoped to raise via crowd-funding???money provided by a collection of individuals???on the Internet.

Teens may buy less tobacco when displays are hidden: study

(Reuters) - Teens may be less likely to buy cigarettes at convenience stores if they aren't sold in plain sight behind the counter, according to a U.S. study conducted using a virtual reality game.

"We know the retail environment is a very important place for tobacco companies to advertise and market their products," said lead author Annice Kim, from the independent research institute RTI International in Research Triangle Park, North Carolina.

"They're prominently displayed at the point of sale, and it exposes all customers, including kids."

Kim's team wanted to test the effects of covering up such cigarette displays on teen shopping and opinion, but the researchers couldn't conduct a real-world experiment because as of yet, no states have banned the displays - although some states are considering it to curb teen smoking.

So they designed a virtual reality game and sent more than 1,200 youth, between age 13 and 17, into a simulated online convenience store.

Researchers asked them to select four items in the store: a snack from the aisles, a drink from the coolers and two products of their choice from the checkout counter.

In some scenarios, the cabinet behind the counter prominently displayed cigarettes, while other teens saw the cabinet closed and the display covered up. Any teens that tried to ask the cashier for cigarettes were denied because of age - but what the researchers were interested in was how many tried to ask.

Depending on other changes they made to the virtual convenience store, the researchers found that 16 to 24 percent of teens tried to buy tobacco products when the display was open, compared to 9 to 11 percent when it was closed.

In a post-virtual shopping survey, whether cigarettes were openly displayed wasn't clearly tied to teens' perceptions of how easy it would be to buy tobacco products if a similar store actually existed in their neighborhood, the researchers reported in Pediatrics.

However, 32 percent of youth said they were aware cigarettes were available for sale when the display case was closed in their virtual store, compared to 85 percent of those who had the open version.

"Policies that require retailers to store tobacco products out of view... could have a positive public health impact," Kim told Reuters Health, adding that the study should be considered along with other evaluations of display restrictions.

But tobacco control researcher Michael Siegel, from the Boston University School of Public Health, said that while he thinks there is "strong justification" for hiding displays from youth, he's not sure how much the study adds to the debate.

"It certainly shows that tobacco displays get people to think about cigarettes, which is what they're there for," said Siegel, who did not take part in the study.

"It can't be extrapolated into real life, because in real life kids would go to a store when they want to buy cigarettes," he added, noting that he was doubtful there were many times when youths hanging out at a convenience store just decided to have a cigarette because they were there and there was nothing to do.

Rather, banning the displays will help prevent youth from being exposed to marketing by tobacco companies and influenced in their attitude towards smoking, he said. SOURCE: http://bit.ly/CxXOG

Jackson's 'Bad' jacket, costumes sold at auction

LOS ANGELES (AP) ? Costumes worn by Michael Jackson commanded hundreds of thousands of dollars at auction, and Lady Gaga was among the collectors.

Gaga tweeted Sunday that she bought 55 pieces in the sale administered by Julien's Auctions and said she plans to keep the items "archived and expertly cared for in the spirit and love of Michael Jackson, his bravery and fans worldwide."

Auctioneer Darren Julien said the jacket Jackson wore during his "Bad" tour fetched $240,000. Two of Jackson's crystal-encrusted gloves sold for more than $100,000 each, as did other jackets and performance costumes.

The auction featuring the collection of Jackson's longtime costume designers Dennis Tompkins and Michael Bush raised more than $5 million. Some proceeds benefited Guide Dogs of America and Nathan Adelson Hospice of Las Vegas.

Brent rises toward $112 as data shows China growth revival

SINGAPORE (Reuters) - Brent crude rose toward $112 per barrel on Monday on signs economic growth was reviving in China, the world's second-biggest oil consumer, and supply concerns triggered by tensions in the Middle East.

Activity in China's manufacturing sector quickened for the first time in 13 months in November, a survey of private factory managers found, adding to evidence of a pickup after seven quarters of slowing growth.

China's data "has been broadly supportive of risk markets and entirely consistent with recent numbers suggesting overall improvement in growth," said Ric Spooner, chief market analyst, CMC Markets in Sydney.

"The market will continue to build a significant risk premium on the probability of disruptions to oil supplies from the Middle East," he added.

Front month Brent futures were trading 34 cents up at 111.57 per barrel at 0309 GMT, after rising 2.3 percent in November. It rose to a high of $111.70 per barrel immediately after the China data release.

U.S. crude added 20 cents to $89.11 per barrel. The contract has broken through a key resistance at $88.75 and could rise to $89.80, according to Wang Tao, Reuters market analyst for commodities and energy technicals.

CHINA REVIVAL

The HSBC Purchasing Managers Survey (PMI) which focuses on private export-oriented manufacturers, rose to 50.5 in November, inching above the 50-mark that separates growth from contraction for the first time in 13 months.

The findings were in line with a preliminary survey released last month and a similar survey by the National Bureau of Statistics. The official PMI rose to a seven-month high of 50.6 for November, from 50.2 in October.

Investors will now be awaiting China's industrial output and trade data later this month for further confirmation of revival in the world's biggest energy consumer.

Also offering support to the oil markets are tensions in the Middle East, such as hostilities between Israel and Palestine, fresh political unrest in Egypt and the conflict in Syria.

Stung by the U.N. General Assembly's upgrading of the Palestinians' status from "observer entity" to "non-member state", Israel said on Friday it would build 3,000 more settler homes in the West Bank and East Jerusalem, areas Palestinians want for a future state, along with Gaza.

Egypt's President Mohamed Mursi called a December 15 referendum on a new constitution, hoping to end protests over a decree expanding his powers, which plunged the country into its worst crisis since he came to power.

Syrian forces pounded rebel-held suburbs around Damascus with fighter jets and rockets on Sunday, opposition activists said, killing and wounding dozens in an offensive to push rebels away from the airport and stop them closing in on the capital.

Adding to jitters, the U.S. Senate approved on Friday expanded sanctions on global trade with Iran's energy and shipping sectors, its latest effort to ratchet up economic pressure on Tehran over its disputed nuclear program.

US FISCAL WORRIES

But worries about United States' fiscal deficit and negotiations on the upcoming fiscal cliff, a $600 billion package of tax hikes and spending cuts which may plunge the world's biggest economy into deep recession, kept oil price gains in check.

"The U.S. fiscal cliff remains the single key factor influencing demand outlook" and markets are veering around to the view that U.S. economic growth will be slower, said Spooner.

The package takes effect at the end of the year and President Barack Obama's administration and congressional leaders are trying to work toward a deficit reduction in the next session of Congress that begins in January.

Police ID woman killed in Chiefs murder-suicide

KANSAS CITY, Mo. (AP) ? Police have identified the girlfriend of a Kansas City Chiefs player killed in a murder-suicide as 22-year-old Kasandra M. Perkins.

Police spokesman Darin Snapp says linebacker Jovan Belcher fatally shot Perkins on Saturday. He then drove to Arrowhead Stadium and committed suicide in front of his coach and general manager

Authorities did not release a possible motive for the murder-suicide, though police said that Belcher and his girlfriend had been arguing recently. The two of them have a 3-month-old child.

Snapp says Belcher's mother recently had moved in with the couple, possibly to help with the baby. She called police just before 8 a.m. to report Perkins had been shot multiple times. Perkins was transported to a hospital, where she died a short time later.

Las Vegas real estate agent, Tania Michaels of Focus Commercial Group, has closed a traditional real estate transaction in which she represented the seller of a rental property who, for four months, had attempted to sell his property without the use of an agent.

Bed bugs found in two NH nursing homes ? Health ? Bangor Daily ...

KEENE, N.H. ? A second Cheshire County nursing home is battling bed bugs.

Representatives with Westwood Care and Rehabilitation Center and officials with the city of Keene confirmed Wednesday the Main Street nursing home facility has bed bugs. A Winchester facility owned by the same company has also been identified as having the bugs.

?We do have bed bugs, and we?re working to eliminate them,? Westwood Administrator Michael Johnson said Thursday.

Meanwhile, a N.H. House subcommittee is examining ways to deal with bed bugs in the state.

The bed bugs in Keene were first discovered Nov. 19, and an exterminator was immediately contacted to address the issue, Johnson said.

?We have had three sightings all isolated to one unit,? he said. A unit consists of multiple rooms.

Johnson said he doesn?t know how the bed bugs got into Westwood, but doesn?t believe their arrival is linked to another nursing center.

Earlier this fall, bed bugs were found at Applewood Care and Rehabilitation Center in Winchester.

Applewood and Westwood are owned by SunBridge Healthcare, which is part of the Sun Healthcare Group Inc.

Westwood is licensed to have 85 residents.

Johnson said educational information about bed bugs has been provided to Westwood residents, families and staff. Families of residents whose rooms were affected were notified, he said.

The educational information included a presentation to explain Westwood?s plan of action to eradicate the bed bugs and data from the N.H. Department of Health and Human Services, he said.

In addition, Westwood staff have been informed of precautions and procedures regarding bed bugs, he said.

Going forward, Westwood ?will continue to follow the guidance of our service provider, and as a precautionary measure, have them perform ongoing checks? for bed bugs, Johnson said.

John Rogers, code and inspections manager for the city of Keene, said his office recorded a complaint about bed bugs at Westwood on Nov. 20, and did an inspection of the facility Nov. 21.

?They already had conducted an inspection of the facility, and found evidence of bed bugs in three or four rooms. They had also contacted a professional company to do inspections and treat for bed bugs,? he said

New Hampshire doesn?t have any regulations pertaining to addressing a bed bug infestation, and because bed bugs don?t carry diseases, an infestation doesn?t have to be reported to local or state health departments.

Rogers said that if his department receives a complaint about a bed bug infestation, it approaches the situation by means of a city ordinance in which infestations aren?t allowed in housing.

?At that point in time, we require the property owner to take care of the situation, and we recommend they use a professional service,? he said.

A property owner would also be required to have a plan to prevent future bed bug infestations, he said.

?We receive about six to 10 complaints about bed bugs a year. We assume this is just the tip of the iceberg,? he said.

Philip J. Alexakos, chief of environmental health and emergency preparedness for Manchester and a representative on the state Legislature?s Bed Bug Subcommittee, said dealing with bed bugs is a complex problem, and one that isn?t easily solved.

?It?s not as simple as putting out a trap or spraying chemicals to get rid of them. It?s an ongoing process,? he said.

Bed bugs were eradicated from the United States after World War II with the use of DDT and other pesticides, he said.

With the use of those chemicals now more controlled, bed bugs developing a resistance to them, and with the increased frequency of people traveling, bed bugs have made a comeback, he said.

The Bed Bug Subcommittee, which is under the N.H. House?s Health and Human Services Oversight Committee, hopes to present a report within the first few months of the new legislative session, he said.

The subcommittee?s work has included collecting state bed bug data and looking at bed bug policies in other states, including New York and Maine, he said.

?Bed bugs are non-discriminating. They just want a blood meal,? he said.

The subcommittee, which grew out of the Bed Bug Action Committee in Manchester, knows that educating people about bed bugs is important to addressing the problem, and informing them of the best practices for dealing with them is key, he said. The state also needs to find a better way to track the problem, he said.

Bedbugs are small, oval insects that feed on the blood of mammals and birds. They often hide in cracks and crevices, and can live in furniture, cushions, mattresses and walls.

Bed bugs can be prevented by inspecting clothing and luggage before it enters a home after a trip, and by checking used clothing and furniture for bugs.

Heat treatments and chemicals applied by an exterminator are the most effective ways to get rid of bed bugs.

?This problem isn?t going away anytime soon,? Alexakos said.
